Inmate ordered to stop filing appeals

An inmate at Pontiac Correctional Center who has filed a dozen unsuccessful lawsuits was ordered to stop filing appeals in a 2009 lawsuit complaining about limitations on his spending at the prison commissary and the amount of time he can watch television.

Inmate Mason Williams has filed appeals of four cases in state court and filed an additional eight federal lawsuits in the past 10 years.

Mason was serving an 18-year prison term for aggravated criminal sexual assault in Cook County when he was convicted of aggravated battery of a correctional officer and sentenced to an additional 20 years.

In the lawsuit, filed in Livingston County in 2009, the 47-year-old inmate claims that his rights were violated by the Department of Corrections and prison staff “by limiting his spending at the prison commissary and restricting him from enjoying sufficient consumption of radio, television and magazines.”

The 4th District Appellate Court agreed with a Livingston County judge, who dismissed the case last year as frivolous.

“In short, it appears that Williams, in an effort to occupy his time while incarcerated, has been engaged in what can best be described as ‘litigation for sport,’ wrote Justice Robert Steigmann.

If Williams want to continue his so-called sport, he will have to pay “for continuing his abuse of the courts,” according to opinion.

The appellate court gave Williams 30 days to explain why he should not face sanctions for filing what it considered an unmerited appeal. The sanctions could include an order that he pay damages, costs of the litigation and attorney fees.
