Corrections Officer bit by HIV positive inmate |

An inmate in the Sequoyah County Jail, who has known he was HIV positive for 12 years, has been charged with assault and battery on a detention officer, after biting the officer hard enough to draw blood. According to the jail report, John Stephen MacMillan, 56, of Sallisaw, was booked into the jail on April 11 on charges of public intoxication, disturbing the peace and failure to appear and pay warrants. Detention Officer Danny Long reported that while escorting MacMilan to a cell, MacMilan became belligerent. Long tried to subdue MacMilan by grabbing him by the back of the shirt collar. MacMilan refused to comply with the officer and began to struggle. During the struggle, MacMilan bit Long on the left forearm hard enough to draw blood. Long was treated at the Sequoyah Memorial Hospital in Sallisaw for his injuries and released. “We got him immediately to the emergency room. He was given some kind of medication that is supposed to ward off infection,” Roger Fuller, Sequoyah County undersheriff, said. Fuller said that suspects brought in on intoxication charges are typically kept separate from other inmates. MacMilan was released on the original charges before further charges could be filed. The report said MacMilan’s wife contacted the sheriff’s department and said her “husband had AIDS and Hepatitis C.” Fuller said the new charges will be a felony charges, because of the HIV status. The report said MacMilan admitted being HIV positive, but did not have Hepatitis C. Fuller said MacMilan’s condition was not known at the time of his arrest, but health issues are listed on the inmates’ health records.
