A federal appeals court yesterday refused to block the execution of Alabama's oldest death-row inmate, a convicted killer who robbed and shot a 62-year-old woman who had befriended him. Lawyers for James Hubbard, 74, appealed to the Supreme Court. He is scheduled to be executed by injection today, despite pleas from his lawyers, who said he is too old and sick to be put to death. The 11th U.S. Circuit Court of Appeals denied their request for a stay. It was unclear when an inmate of Hubbard's age was executed. According to the Death Penalty Information Center, he would be the oldest put to death since executions resumed in 1977. The Coalition to Abolish the Death Penalty has said Hubbard would be the oldest executed since 1941. |
