No porn allowed for Macomb County Jail inmates? That creates "inhumane and unconstitutional living conditions," said Kyle Richards, who filed a civil rights complaint in U.S. District Court that accuses the Michigan Department of Corrections, county and municipal jails and state facilities of creating sexual and sensory deprivation. Richards, who has had at least three other federal court complaints dismissed as frivolous, has until July 29 to pay a $350 filing fee or his June 10 complaint will be dismissed. But Richards said he is indigent and cannot afford the filing fees, according to court documents. Under the Prison Litigation Reform Act of 1995, the court may dismiss a case if, on three or more previous occasions, a federal court dismissed the incarcerated plaintiff's action because it was frivolous or malicious or it failed to state a claim for which relief may be granted, according to court documents. Richards, 21, is to be sentenced Aug. 2 after pleading guilty last week in Macomb County Circuit Court to bank robbery. He filed his complaint against Gov. Rick Snyder, the State of Michigan and the Michigan Department of Corrections. He is asking that jails and prisons allow personal televisions, video game systems, portable/handheld video games, radios, and erotic/pornographic material. He states that indigent inmates should be allowed to be loaned or donated such items.
