| 4 inmates file suit against Hays State Prison |

Four former Hays State Prison inmates who say they were restrained and beaten have filed a federal lawsuit against the Georgia Department of Corrections. The men, who filed their suit in U.S. District Court in Rome on Tuesday, allege they were beaten by officers employed by GDC while the inmates were handcuffed. One man claimed he was beaten until he lost consciousness. The Southern Center for Human Rights along with along with Atlanta law firm Hunton & Williams LLP are representing the four men — Miracle Nwakanma, Cornelius Spencer, Eric Towns and Gregory Haines. According to the SCHR, the four men say that on Aug. 12, 2010, they were the victims of “retaliatory beatings” by members of the GDC’s Correctional Emergency Response Team and other officers at the state prison in Trion. Atteeyah Hollie, attorney for the men, says this is not the first time the SCHR has filed a suit against Hays State Prison for assaults on prisoners. In 1997, SCHR settled a civil rights lawsuit on behalf of 14 men who were subjected to unprovoked beatings during a prison “shakedown” led by former GDC Commissioner Wayne Garner. “This is a reoccurring problem where prisoners are being subjected to unnecessary force,” Hollie said. “The Department has not received this complaint. We also do not comment on pending litigation matters,” said Gwendolyn Hogan Public Relations and Information Specialist for the DOC. Plaintiff Nwakanma alleges that while handcuffed he was punched, stomped, kicked in the groin and face, struck with a flashlight, hit with batons, and beaten until he was unconscious. Read More. |
