Suit challenges AZ execution methods

Defense attorneys Wednesday filed a suit in Maricopa County Superior Court claiming that the Arizona Legislature delegated too much authority to the director of the Arizona Department of Corrections to determine how Death Row inmates are executed.

The suit, filed by the Federal Public Defender's Office on behalf of Thomas West, who is scheduled for execution Tuesday, and three other inmates, notes that state statute dictates how animals are euthanized but not how lethal injection is carried out. Instead, it allows the process to be established by the Corrections director.
