Fired ACI guard won’t face charges

Saying getting fired was punishment enough, the state has decided it won’t criminally prosecute a former corrections officer for creating a Facebook page that implied it belonged to Corrections Department Director A. T. Wall, prosecutors told the man’s lawyer Friday.

“ … The fact that your client has been terminated as a corrections officer leads to the conclusion that substantial justice has been achieved in the matter,” Assistant Attorney General Thomas H. O’Brien said in a letter to John R. Grasso, the lawyer representing ex-corrections officer Matthew S. Lacroix.

The state had threatened to prosecute Lacroix for impersonating a state official. Grasso had argued that charge was inappropriate because while Lacroix had created a Facebook page supposedly for someone named “A.T. Wal,” Grasso said it was clearly meant as a joke, not a serious impersonation.

Though the state opted not to charge Lacroix, O’Brien’s letter indicated that the state found the “it was just a joke” defense disingenuous. Lacroix created the page on a relatives’ computer without their knowledge, he said, and used a different online name, one that matched the name of another correctional officer.

If the page was meant in good-natured fun, O’Brien said, then why did Lacroix go to the ends he did to hide his identity as its creator. “... His efforts to conceal his role in creating the page bear out his awareness of the inappropriateness of his actions at the very least,” O’Brien wrote.

Grasso said he had no comment on the letter beyond the decision not to charge his client.

“I think the state did the right thing,” he said.
