| HIV-positive inmates await decision in suit |

A little more than six months after a lawsuit was filed on behalf of HIV-positive inmates, a judge has not issued a ruling in the case. The ACLU of Alabama filed the suit in late March, claiming the Alabama Department of Corrections was unfairly segregating the prisoners at the Limestone Correctional Facility and at Julia Tutwiler Prison for Women in Wetumpka. South Carolina is the only other state that segregates HIV-positive inmates from the general prison population. ACLU of Alabama attorney Allison Neal said a hearing was held Sept. 16 on motions filed in favor of and against the lawsuit, but a judge has not issued a ruling. She said the ACLU plans to file its discovery plan shortly. The lawsuit, filed in U.S. District Court for the Middle District of Alabama, names Alabama Gov. Robert Bentley, ADOC Commissioner Kim Thomas and a handful of other ADOC officials. Read More. |
