The Santa Clara County (Calif.) Sheriff's Office obtained an arrest warrant last week for a former correctional officer who allegedly had a sexual relationship with an inmate. Jacqueline Maristela, 29, has been charged with a felony count of engaging in sexual conduct with a consenting inmate and a misdemeanor count of unlawful communication with an inmate, according to District Attorney Karyn Sinunu. Maristela had worked as a correctional officer for five years at the women's facility at Elmwood County Jail in Milpitas. She allegedly engaged in sexual relations with a 22-year-old female inmate on multiple occasions between October 2003 and February 2004, Sinunu said. The inmate, who was being held on identification fraud and grand theft charges, has since been sentenced to five years in state prison and transferred to another facility. Maristela resigned from the department on June 24 amid the investigation. Correctional Officers Jennifer Daniel and Muoaz Ismeal have also been charged with a misdemeanor count of unlawful communication with an inmate for allegedly passing on information that "helped foster the sexual relationship,'' Sinunu said. Daniel has been employed as a correctional officer for five years with Ismeal serving for 15 years. Both officers have been placed on administrative leave pending the outcome of the investigation, according to Department of Corrections spokesman Bryan Peretti. Peretti said that correctional officers are typically supervised when around inmates and are never permitted to provide any information other than correctional policies. Both Daniel and Ismeal turned themselves in today and were released on their own recognizance. The maximum sentence for the misdemeanor charge is one year in county jail while the maximum sentence for the felony sexual conduct charge is three years in state prison, according to Sinunu. |
