On Halloween, Loopholes in Sex Offender Laws Mean Some Can Give out Candy |

JACKSONVILLE, Fla. -- On Halloween, the safety of children roaming neighborhoods and prevailing on neighbors - some strangers - for candy put some parents and law enforcement on alert. One concern is the possible threat of sex offenders, and while there are protections in place for the public, there are loopholes in those laws. MORE: Halloween events The Florida Department of Corrections lays out the rules for offenders very clearly. During Halloween, for those on the sex offender registry, Halloween activities are illegal. They cannot display decorations, distribute candy or leave their outside lights on. There's a "sex offender form we give to every sex offender and sex predator on supervision," said Rusty Park, a spokesman for the DOC. But these rules apply only to those who are still under supervision of the DOC, which means sex offenders off probation are free to trick-or-treat. That concerns Park, he said. "I have grandkids that live in this county." Local law enforcement is aware of the loophole and some Florida counties now take their own steps to close the gap. In Baker and Clay counties, sex offenders and predators, off probation, can trick-or-treat. St. Johns and Duval counties have adopted laws to make sure no child is around a sex offender at Halloween.
