COVINGTON, KY — A 51-year-old man who police say tried to run over his wife last year has been ruled incompetent to stand trial and is now a free man. Ralph Daniel Jr. spent a year and nearly five months in the Kenton County jail awaiting trial on charges that he tried to kill his wife Alison Gross, 39, by running her over with his car. A doctor from the Kentucky Correctional Psychiatric Center testified Monday that Daniels is not competent due to cirrhosis of the liver, said Assistant Commonwealth’s Attorney James T. Redwine. The doctor told Judge Martin Sheehan that the liver disease is affecting Daniels cognitive ability, Redwine said. Daniel was evaluated at the center after his public defender Erick Eckes noticed he was having trouble remembering things. Psychiatrist Timothy Allen told the judge Monday that Daniel is not likely to get better and will die without without a liver transplant. “His medical condition is impacting his mental abilities,” Redwine said. Redwine asked the judge to dismiss the attempted murder and wanton endangerment charges against Daniels, who had been facing up to 25 years in prison if convicted. “The evidence, we believed, was pretty overwhelming that he intentionally struck the victim with a car,” Redwine said. “I think the evidence was pretty compelling and so it’s in great reluctance that the charge was dismissed.” Sheehan agreed and Daniel was released from the jail about 6 p.m. Monday.
