Inmate who assaulted officers to be punished

COXSACKIE, NY — The state Department of Corrections and Community Supervision says the Coxsackie Correctional inmate who set fire to his cell and struck at least two guards over the weekend will be punished.

“In this instance, as with any violent act, the perpetrator will be held accountable and, following an internal investigation, disciplined,” spokesman Peter Cutler said in a statement. “We may also refer the matter to outside law enforcement for further investigation and possible criminal prosecution.”

It’s alleged that around 12:30 a.m. Sunday, 28-year-old inmate Nathaniel Richardson of Erie County set fire to his cell.

“When staff responded and opened the inmate’s cell door, the inmate attacked one correction officer by punching him in the face twice,” the New York State Correctional Officers & Police Benevolent Association said in a statement. “Several officers and a sergeant then restrained the inmate — who was violently struggling and would not comply with the staff’s directions.”

The inmate was then taken to Albany Medical Center, where he allegedly became violent and hit another guard in the face with his elbow.

He reportedly had to be restrained while medical staff sedated him.

A total of six guards were injured in the two incidents. The extent of their injuries was not disclosed.

The disciplinary actions taken could include confinement for 23 hours a day, loss of privileges or a lengthened sentence.

Richardson was released from prison in July 2008 after serving three years for a drug conviction, but he was returned from parole after the burglary conviction.

His earliest release date would be in December 2015.

This isn’t the first time Richardson has become violent, DOCCS spokeswoman Linda Foglia said.

He was transferred to Coxsackie, a maximum-security facility, in September from medium-security Gouverneur Correctional Facility in northern New York; he was sent to Gouverneur to serve disciplinary time after participating in violent conduct and fighting in May at Oneida Correctional Facility, Foglia said.

And just four days before Sunday’s assault, Richardson was involved in a violent incident, she said.

The correctional officers’ union argues that Sunday’s incident was “the latest example of a corrections system that is becoming overcrowded and less secure for the men and women who work there.”
