| House approves bill giving victims a voice in clemency |

A bill that would give victims the opportunity to comment on a prison inmate's request for clemency cleared the South Dakota House of Representatives on Monday afternoon. The South Dakota Department of Corrections requested HB 1021, which gives a victim the right to provide written comments at clemency hearings with the Board of Pardons and Paroles and written comments when clemency is considered by the governor, Rep. Chuck Turbiville, R-Deadwood, told the House when the bill was considered Monday. The bill passed 66-0. As the statute is currently written, a victim's right to provide written comments only extends to parole hearings with the board, not clemency hearings, and only to consideration of sentence commutations by the governor, Turbiville, said. The legislation applies to prison inmates incarcerated before and after 1996. Parole practices changed on July 1, 1996. Since then, an inmate entering the corrections system has received a pre-determined or presumptive parole date. A number of factors are used to determine that date: the type of crime (violent or non-violent), number of convictions and the inmate's cooperation in completing a prescribed set of rehabilitation programs prior to his or her eligibility date.
