Arbitrator reinstates suspended SCI-Pittsburgh guards |

An arbitrator ruled that eight SCI-Pittsburgh corrections officers suspended in an abuse investigation – five of whom now face criminal charges – at the Woods Run prison must be reinstated to their posts. In the ruling, dated yesterday and released this morning by the union representing the officers, arbitrator Ronald F. Talarico wrote that the eight guards were "improperly suspended in violation of their constitutional rights to procedural due process," and ordered them reinstated with full back pay and benefits. "It is also important to re-emphasize that this decision is based strictly upon procedural irregularites and has absolutely nothing whatsoever to do with whether the Grievants committed any of the alleged horrendous and despicable acts of which they stand accused," Talarico wrote. The state suspended the guards last spring, and then the Allegheny County District Attorney`s Offce charged six of them with various offenses in the fall. Harry Nicoletti, 60, of Coraopolis was deemed the worst of the offenders by prosecutors and charged with sex crimes related to some inmates. He is awaiting trial. Other guards were similarly charged, with prosecutors saying they either participated in or knew about the abuse and did nothing to stop it. District judges dropped charges against Kevin Friess, 31, of Bellevue and Brian Olinger, 32, of Washington following inmate testimony earlier this year. Read More. |
