Blanket strip-searches in N.J. more than just illegal

The U.S. Supreme Court justices have ruled it’s not their place to interfere in strip-search procedures at detention centers.

But that doesn’t mean the state can’t. What happened to Albert Florence, the New Jersey man who sued after he was mistakenly arrested and then strip-searched — twice — was outrageous. Not only is this practice a violation of common sense and decency, it is a violation of state law that our Department of Corrections must make sure is never repeated.

After all, you could be next. Say you forget to pay an outstanding traffic ticket and you end up in county jail. Here’s what a strip-search would mean: You’d be ordered to take off all your clothes. As you stand naked, you’d have to open your mouth and lift your tongue — and then your testicles or breasts, so an officer could look beneath them. You’ll be told to “squat and cough,” as the officer closely examines the result.

This kind of procedure is banned by various international human rights treaties. And so far, everyone’s focused on the constitutionality of these searches. But in a surprising find, New Jersey actually has a statute on the books that bans automatic strip searches.

    The facility should have strict SOPs in place regarding strip searches. In reality the basis for a valid strip search would be when an inmate is arrested for drug sales or possession then it would be appropriate to prevent the introduction of contraband into the facility. Documentation should be done on any strip search and approved in writing by a supervisor.
