Federal judge says Dallas County jail officers can be sued over inmate's death |

Texas -- If you're a nurse or jail officer who neglects or abuses an inmate who later dies, you can be held personally liable in court. That's the message from U.S. District Judge Ed Kinkeade in recent rulings he issued in two federal lawsuits filed by the families of inmates who died in the Dallas County jail. Kinkeade ruled on March 28 that four Dallas County sheriff's jail officers -- Julia Quiroga, Craig Elliott, Timothy Click and Daniel Moreno -- are not entitled to immunity in a lawsuit over Corey Bailey's death. A fifth officer, Quinton Lacy, was fired for lying about the incident and was not part of the motion in question. Bailey, shown here, died in the jail in 2008 after a struggle with the officers, who were moving him to a different jail facility for a mental health evaluation. The Dallas man had been suffering from paranoid delusions and scuffled with the guards, who subdued him with pepper spray, reports said. Bailey's mother, Cathy Bailey, sued the officers and the county, alleging the officers used excessive force and failed to get her son needed medical treatment. Kinkeade wrote in his ruling that Cathy Bailey's version of events raise questions about whether Bailey's constitutional rights were violated and whether the officers' conduct was "unreasonable under the circumstances."
