Prison officer loses fired appeal

TRENTON, NJ — A South Woods State Prison corrections officer who was fired after he was convicted of refusing to take a breathalyzer test has lost an attempt to get his job back.

A state appellate court Monday rejected Anthony McIver’s appeal of a Civil Service Commission decision that removed him from his job at the Bridgeton prison.

McIver, a senior corrections officer employed by the state Department of Corrections for 14 years, was arrested in November 2009 on charges of driving while intoxicated and refusing to submit to a breathalyzer test. He pleaded guilty to the breathalyzer offense in June 2010 in Vineland Municipal Court.

The crime was McIver’s third DWI offense. The court revoked his driver’s license for 10 years, among other penalties.
