Corrections officer loses job over sick day abuse

MANSFIELD, Ohio -- A longtime corrections officer was fired after his superiors at the sheriff's office videotaped him pouring concrete for pay after he called off sick from work.

Richland County Sheriff's Sgt. Oscar S. Benavides Jr. was terminated May 9 after an administrative investigation into disciplinary charges against him, according to a letter signed by Richland County Sheriff J. Steve Sheldon.

According to Benavides' personnel file, which the News Journal obtained through a public records request, Sheriff's Capt. Eric Bosko, Detective Bob Mack and Capt. Joe Masi surveilled Benavides at a job site in Lexington and took photographs and videos of him doing physical labor with a concrete and construction company he owns.

Based on what they found, Masi initiated a personnel complaint on Benavides for "making false claims or misrepresentation in an attempt to obtain any county benefit and gross neglect of duty."

"Benavides called in sick, but it was in direct conflict with what he was observed doing at the worksite," Masi stated. Masi said Benavides applied for light duty from March 1 through May 7 "based on his inability to work his normal duties due to risk of injury."

Yet several times during that period, Benavides was observed "lifting large pieces of concrete, bending over sawing concrete, pushing and pulling a rake through poured concrete and all the other risks associated with this type of construction," Masi stated.

A sheriff's office complaint details that Benavides called off sick several times during the period of light-duty assignment, creating overtime for the department. He also missed mandatory training held April 4, the complaint shows.
