‘Ice’ defendant assaults Corrections officer in jail |

FORMER Department of Corrections Officer Jesse Reyes Babauta, who was arrested on federal “ice” and gunrunning charges, is now accused of assaulting a Corrections officer while inside the local jail on Aug. 23, 2012. As a result, Babauta, a federal detainee, has been restricted to his prison cell from Aug. 25, 2012 to Oct. 23, 2012, or a total of 60 days. Babauta was among the 10 individuals, including former and current CNMI law enforcement officers, who were arrested on Aug. 22, 2012 by federal and commonwealth authorities on “ice” and gunrunning charges. The disciplinary sanction imposed on Babauta was based on his offense of assault on a Corrections officer, described as Category III (high severity scale) under the CNMI Department of Corrections Rules and Regulations on Inmate Prohibited Acts and Discipline. Babauta is not allowed to make or receive regular phone calls during the restriction period, except from his attorney. He will not have commissary privileges; will not have visitors; and will be out of his cell for fresh air for one hour only, excluding inclement weather, according to Corrections Capt. Georgia Cabrera. According to court records, Babauta was called in by Corrections Officer I Leeson Skilling from the jail’s mini-basketball court for an attorney visit on Aug. 23, at about 2 p.m. Babauta threw a basketball at the Corrections officer, court documents stated. Babauta entered the corridor, walked toward the officer and stated in a harsh tone, “What?” Skilling described Babauta as “gesturing to punch me.” While Skilling was applying hand restraints on the defendant, Babauta “held [Skilling’s] hands” while saying: “I am not scared of you, see what I can do.” Skilling then pushed Babauta and took out his pepper spray.
