Federal appeals court withdraws decision for Idaho inmate |

A Blackfoot, Idaho man could be back on death row again. A federal appeals court has withdrawn its decision to throw out the death sentence for murderer Richard Leavitt. Back in June the appellate court ruled Leavitt would have to be retried and could only serve a maximum sentence of life. Last Tuesday the three judge panel did allow Leavitt to continue his challenge to execution on grounds that he didn't have effective legal representation. Leavitt was convicted of killing Daneette Jean Elg in 1984. |
