Court rules ex-inmate can sue Texas prison officials |

A federal appeals court has ruled seven Texas prison officials can be sued for discrimination based on sexual orientation claims brought by a gay former inmate. Roderick Johnson says he was raped nearly daily by prison gangs and sold as a sex slave for five dollars while doing time at a facility near Wichita Falls. The American Civil Liberties Union suit says prison employees ignored his pleas to be moved to a "safekeeping" area for gay and other vulnerable inmates until the A-C-L-U intervened. Texas officials are reviewing the ruling before commenting. The corrections department had argued that the employees were immune from being sued because the law did not clearly establish whether their conduct violated Johnson's rights. |
