| Arson killer mistakenly released from prison |

An admitted killer was inadvertently released from prison and has been roaming the streets for the past six weeks, missing a deadline to turn himself in. William Nesmith, 28, who pleaded guilty in 2001 to his role in a fire at a crack house that killed two men, was released from the Curran-Fromhold Correctional Facility in Pa. on July 31 because of a clerical error. In a letter addressed to Nesmith in late August, prosecutor Ed Cameron told the fugitive that if he did not surrender to police by Sept. 3, the district attorney's office would revoke a plea agreement and go to trial against him for the murders. "I can then use every statement you have made against you," Cameron wrote in the letter, which added, "I strongly urge you to surrender." Nesmith has not responded to the letter, Ed McCann, chief of the DA's homicide unit, told the Philadelphia Daily News for last Tuesday editions. "Our fugitive people are looking for him," McCann said. Nesmith, who had been an inmate since November 1999, was scheduled to be sentenced in January after pleading guilty to two counts of third-degree murder and conspiracy. Authorities said he and three other men robbed and set fire to a north Philadelphia crack house in 1999. In his plea agreement, Nesmith promised to testify against a co-defendant. He faces 20 to 40 years in prison, McCann said. Nesmith and another inmate, Raymond Nesbitt, are represented by defense attorney Brian McMonagle. After the state Supreme Court ordered Nesbitt's release in a separate case, McMonagle's secretary, preparing the release order, apparently mistook Nesmith for Nesbitt. Philadelphia Common Pleas Judge Benjamin Lerner, unaware of the clerical error, signed the order. Nesmith's father, William Bullock, said he has not heard from his son since the day he was released. He urged his son to surrender. |
