| CCA inmate gets six years for escape |

An inmate's 15 hours of freedom after escaping from Marion County (Ind.) Jail II earned him an additional six-year prison sentence. Marion Superior Court Magistrate Amy Barnes last Wednesday ordered Leo Deberry, 24, Indianapolis, to serve the six years after he completes the 14-year term he was serving for burglary and dealing cocaine. Deberry pleaded guilty to escape and begged for mercy. "I know what I did was wrong," he said. "It's not too much I can say other than I throw myself on the mercy of the court." Deberry escaped while attending a church service, a fact defense attorney David Margerum offered as a factor the judge could use to lessen the sentence. Barnes chuckled at the request. Minutes later she handed Deberry two years less than the maximum eight years he could have received. Deberry had been sentenced June 4 on the burglary charge and was being held in the Jail II pending transfer to an Indiana Department of Correction facility. He had been in a community transition program for his 2001 conviction for dealing in cocaine when he was arrested in November 2003 on the burglary charge. Deberry was captured June 7, about 15 hours after he escaped from the privately run jail at 730 E. Washington St. He is the first inmate to escape from the facility. He left a chapel service and entered a manager's office on the second floor. He pried open the metal gate protecting an exterior window and lowered himself to the ground. Deberry's escape went unnoticed by officers for about 41/2 hours. Police found him hiding between two cars in a parking lot. Jail II opened in 1997 to help ease crowding at the main jail nearby. It houses 960 adult male inmates. The jail is owned by the county and run under contract by Corrections Corporation of America, based in Nashville, Tenn. Officials at Jail II could not be reached for comment last Wednesday. |
