Family members of an inmate who died after suffering a heart attack at the Warren County, N.J., jail plan to file a wrongful death suit against county officials, their attorney said. Michael Hodges, 50, a former Arkansas resident, died Aug. 1 in the county jail. Clinton attorney Richard Hurley last week filed preliminary notice of the pending lawsuit on behalf of Hodges' estate. That's the second such lawsuit notice filed in the Hodges case. An earlier notice was filed by Hodges' estranged wife, Linda L. Lee of Phillipsburg. The notice filed by his family members includes a money claim of $5 million, according to Hurley. The earlier notice on behalf of Lee includes a $3 million claim. Hodges suffered the heart attack about 4:24 a.m. in a minimum security housing dorm at the jail. He collapsed after asking a corrections officer for one of his prescribed nitroglycerin pills, authorities said at the time. Hodges was being held at the jail in lieu of $25,000 bail since his extradition from Arkansas in February. He was charged with interference with child custody for allegedly failing to return his son to Lee in 2000. The warden has said Hodges was carefully monitored since his arrival at the jail in February and never showed any obvious signs of a major problem until his sudden collapse Aug. 1. |
