| Federal investigation targets top state Justice official for alleged illegal gun sales |

SUPERIOR — A top state Department of Justice official is under federal investigation after a DOJ agent reported to his superiors and federal authorities that the official was manufacturing and selling firearms without a license and claimed to own a stolen machine gun. However, DOJ spokeswoman Dana Brueck said Thursday her agency does not expect any charges to be filed against Jay Smith, special agent in charge of the Division of Criminal Investigation’s Superior Office. Among those who allegedly bought weapons from Smith was Attorney General J.B. Van Hollen. The investigation by the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives in St. Paul, Minn., was launched about five months ago. A veteran DCI drug agent, Dan Bethards, reported that Smith, his boss, was manufacturing and selling firearms to fellow law enforcement officers without a license and that Smith claimed to own a stolen U.S. government-issued fully automatic rifle.
