| Inmate's kin sue state for $60 million |

The family of a state prison inmate from Richmond, Calif. who died after dental surgery filed a federal civil rights suit against the Department of Corrections last week, claiming the state routinely deprives prisoners of adequate medical care. Anthony Shumake, 41, died at a Manteca hospital June 28 after surgery six days earlier at Solano State Correctional Facility in Vacaville to remove a wisdom tooth. The procedure resulted in an infection that blocked his airway, according to court papers filed by his family. "We are losing lives in those institutions, and for the most part, we'd never know about it," said the Rev. Andre Shumake, the victim's uncle and a prominent Richmond minister and activist. "It was a violation of his civil rights, which I am personally now finding out is a pattern and practice in the penal system of California." Rev. Shumake is not among the named plaintiffs, but spoke on behalf of the family. A state spokeswoman declined comment on the suit, which seeks $60 million in damages and was the subject of a news conference Monday on the Capitol steps by the activist group United for No Injustice, Oppression or Neglect. |
