A criminally insane man with a history of violence in custody has been indicted on a murder charge in the fatal beating of a frail, mentally ill Cherry Hill man inside the Camden County (N.J.) Correctional Facility. A grand jury sitting in Camden presented an indictment to the Superior Court late last Wednesday against Marvin Lister in the Jan. 27 attack that left Joel Seidel dead, officials said. Seidel, 65, a former stockbroker from Cherry Hill, had been jailed for nearly a month for violating a restraining order won by his ex-wife and daughter. They had called police in hopes he would receive help for his mental condition. Seidel, who could have been released on payment of $150 bail, was killed shortly after he was placed in the same cell as Lister, 35, who was awaiting trial in Camden over an alleged sexual assault on another patient at the Ancora State Psychiatric Hospital. Lister had been committed involuntarily to a state psychiatric facility since April 1995, when he was found not guilty by reason of insanity in three cases, including assaulting an Ancora employee and a state prison officer in separate attacks in 1994. The indictment charges Lister with a single count of murder after he allegedly choked, stomped and beat Seidel to death. He faces 30 years to life in prison. But before a trial can be held, psychiatrists must determine whether Lister, now held at the Ann Klein Forensic Center in Trenton, is competent to stand trial. |
