Prison lets inmate stay after sentence

Some are questioning if the state's prison system is running a hotel after at least one inmate was allowed to stay after his sentence was served. He got free meals and a free room at the expense of tax-payers.

Department of Corrections spokesperson Alex Tomlin said the inmate, who's name cannot be released, was scheduled to be released Sept. 26. He would end up staying until Oct. 15.

That means the inmate stayed an extra 19 days after his sentence was complete.

Tomlin said each day costs about $128. If you include the day he was supposed to be released, his total stay cost $2,560 in tax-payer money.

"Our stance has always been to do what's right for the community and what's right for the offenders," Tomlin said, adding the inmate was housed in Los Lunas because he suffers from multiple sclerosis. She said a long-term facility that had agreed to take him after his release backed out.

Prison officials said a half-way house wouldn't have been able to tend to the inmate's medical needs. So Tomlin said they had to keep looking.

"They tried about 20 different facilities trying to find someone that would be willing to take him," Tomlin said.

Tomlin said public safety was also a concern because the inmate is a repeat offender.
