Former corrections officer awarded damages in workplace bullying case |

A former senior Victorian corrections officer has been awarded $125,000 damages against the Department of Justice for workplace bullying. Susan Dawson, 61, was also awarded $188,000 for the loss of past and future earnings by Judge Katherine Bourke in the County Court. Judge Bourke on Thursday said Ms Dawson was bullied by a fellow officer who became her manager at Warrnambool between 2002 and 2003, and 2005 and 2006. In her judgment, Judge Bourke said the failure to take appropriate steps about the bullying and about Ms Dawson's complaints was the cause of her injury. She awarded Ms Dawson $125,000 for pain and suffering. The department, which denied the allegations, submitted that Ms Dawson was a difficult employee who was resistant to ‘‘management actions’’. It also argued that a number of incidents she alleged had not occurred. In her statement of claim, Ms Dawson alleged her employer had a duty to take reasonable care for her safety and that the injury she suffered was a breach of that duty and/or negligence. She had alleged the department had permitted her to be repeatedly bullied by the manager, Phillip Pettingill, and had failed to provide her with any or adequate supervision or assistance.
