Suit filed over requiring inmates to pay jail costs |

Two former prisoners at the Clinch County (Ga.) Jail filed a federal lawsuit against the county's practice of charging people $18 a day for room and board while they are incarcerated awaiting trial. To be released, they have to pay the money or sign an agreement to pay over time. If they fail to make the payments, they can be returned to jail. The lawsuit contends the southeast Georgia county's sheriff has no authority to charge such fees to people who have yet to be convicted of a crime. According to the lawsuit, filed last Tuesday in U.S. District Court in Valdosta, most of the inmates are too poor to pay the fees. It seeks class-action status on behalf of all current and former inmates who have had to pay the jail fees. The lawsuit says the county also should be ordered to return all room-and-board fees it has collected from inmates. But Sheriff Winston Peterson said the county has been charging jail costs since before he took office 16 years ago. Peterson said the taxpayer shouldn't have to cover the costs of someone who has done something wrong. |
