| State moves to dismiss lawsuit against corrections officials |

Randall McLellan’s civil case against his Alaska Department of Corrections bosses for alleged civil rights violations and selective persecution has been moved from state Superior Court to a federal venue. Now a U.S. District Court judge will decide whether two top state officials abused their power, though the defense quickly moved to dismiss claims they took “adverse action” against a subordinate. McLellan's lawsuit charges DOC Commissioner Joseph Schmidt and Director of Institutions Bryan Brandenburg with violating his civil rights and improperly pepper spraying him as part of a retraining effort.
