| Georgia Supreme Court directs courts to recalculate inmate’s attorney fees in injury lawsuit |

The Georgia Supreme Court has upheld part of a Georgia Court of Appeals decision that requires the Department of Corrections to pay the legal fees incurred by a Walker County prison inmate who sued the department after he was injured while painting the warden’s house. However, in the unanimous opinion, issued June 16, written by Justice David Nahmias, the high court rejected the trial court’s calculation of the attorney fees award, and it is sending that issue back to the Court of Appeals with direction that the case be remanded to the Walker County court for recalculation. According to the facts of the case, David Lee Couch was part of a team of Walker State Prison inmates who were painting the warden’s house when a dry-rotted joist gave way, causing him to fall and land with his legs straddling a joist.
