| Sheriff worries new criminal code will worsen jail overcrowding |

GREENSBURG — Local law enforcement officials worry that already crowded jails will become more cramped because of state legislation that will require more low-level offenders to be housed at county jails — rather than the state prison system. The new legislation, which took effect July 1, updated the criminal code and changed, among other things, classifications of felonies. Previously, felonies were rated A to D, with D being the lowest. Now, felonies are rated Level 1 to 6, with 6 being the lowest. The law also requires counties to handle all criminals convicted of Level 6 felonies. Previously, all felony cases were automatically handled by the Indiana Department of Corrections. Decatur County Sheriff Greg Allen and Kenny Whipker, a former sheriff who inspects Indiana jails for the DOC, said they worry that the legislation will increase space constraints in Indiana jails, most of which already are crowded and understaffed.
