| Judge overturns murder convictions for S.C. inmate on death row |

A circuit judge has overturned death row inmate Theodore Kelly's 1995 double-murder convictions and his death sentence in a Spartanburg County case. Circuit Judge Larry Patterson's ruling is based on findings of prosecutorial misconduct, juror bias and improper action by the judge in Kelly's trial. Kelly was convicted of murder in the death of his estranged wife Imogene and her daughter's fiance, Keith Alexander Epps. Kelly will remain behind bars pending a request for bond by his attorneys. Assistant Deputy Attorney General Donald Zelenka says he has not seen Patterson's ruling and has not made a recommendation on whether to appeal to the state Supreme Court. |
