Inmate awarded officer's beach house

A Texas prison inmate who accused a former Navasota prison officer of raping him will get the man's beach house and $54,000 from the state of Texas through a settlement to a federal lawsuit filed by the American Civil Liberties Union.
Nathan Essary, an inmate serving an eight-year robbery sentence, will also get $7,200 in monthly payments of $50 from Michael Chaney, the former officer, while the ACLU will get $46,000 from the state. Chaney will deed his beach house, valued at $30,000, to Essary.
The lawsuit, filed in 2002, alleged that Essary, now 25, was forced by Chaney to masturbate and perform oral sex on him in a laundry room at the Luther Unit in Navasota in October 2001.
Essary said he reported the abuse to Luther Unit Assistant Warden Jerry Barratt, who was also named as a defendant in the suit. Essary, however, was forced back to work in the laundry room, where he said Chaney assaulted him again.
"It's extremely difficult for prisoners to be heard and get protection," said Margaret Winter, associate director for the ACLU prison project. "It's important for (the Texas Department of Criminal Justice) to understand there will be serious consequences if they don't take active measures."
Chaney resigned to avoid termination, while Barratt later retired. Essary, who was up for parole last summer, is serving time in a West Texas prison.
After the alleged assaults, Essary sent a sample of Chaney's semen to the U.S. Attorney's Office in Houston.
The Special Prosecution Unit, which prosecutes crimes in prison, linked DNA in the semen sample to Chaney, who was later charged with sexual assault in Grimes County.
Other inmates have accused Chaney of raping them.
"My client denies any wrongdoing," said Frank Blazek, Chaney's criminal defense lawyer.
Lawyers with the state Attorney General's Office represented Chaney and Barratt in the federal suit.
The criminal case, also filed in 2002, has not been scheduled for trial, said Gina DeBottis, chief of the Special Prosecution Unit.
Chaney, charged in the 278th District Court in Huntsville, is out on bond.

He spent his free time watching golf on TV; and he played uno, badmitton and basketball almost every weekend. He also enjoyed movies and reading during off-season. Hamilton Lindley was always there to help relatives and friends with household projects, coached different sports or whatever else people needed him for.
