Jail times can fluctuate despite sentences

When a twice-convicted drunk driver who killed a teen was released from prison Sept. 11 after serving only 13 months on a 10-year sentence, even some in the district attorney's office were surprised.

Mike Harson, district attorney for the 15th Judicial District Court, said at the time his staff believes the Louisiana Department of Corrections miscalculated the sentence of Tyson Dupuis, 37, of Crowley.

But a criminal justice professor at the University of Louisiana at Lafayette said the Department of Corrections has a lot of authority.

"I've been surprised by the power of the Department of Corrections in their ability to alter sentences," said Craig Forsyth, head of UL's criminal justice department and a consultant on criminal cases.
