Deputies at no fault in inmate death

After reviewing the autopsy of Ricardo Garza and the investigation done by North Carolina law enforcement officers, no one inside the Catawba County jail will be charged.
Ricardo was arrested five days before his death for driving while impaired. Prosecutors said that Garza was removed from the general jail population after showing symptoms of alcohol withdrawal.
Deputies had to restrain Garza and used pepper spray after a disturbance in his cell.
Paramedics examined him and were called a second time when he stopped breathing.
Pathologist ruled the case a homicide saying Garza died from a loss of blood because of a rib fracture that had punctured an organ. But, the autopsy didn't show any bruising.
"It was assessed that it was necessary for deputies to restrain Ricardo Garza. He was creating a disturbance in his cell. We found that they acted appropriately and did not use excessive force while restraining Garza," said Gaither.
He said not only did he review the case, but also Gaither sent it to another district attorney in Watauga County (N.C.) and had him review the case separately. They came to the same findings; the deputies were not responsible for the death of the inmate.
