OKLAHOMA CITY — Charles Warner awaited word from the U.S. Supreme Court but ultimately didn't get a last-minute reprieve from the death chamber in McAlester on Thursday night. The state executed Warner, 47, for raping and killing an 11-month-old girl in 1997. Instead, four of the Supreme Court's nine justices issued an unusual opinion that one attorney says could signal a shift in how the court handles death penalty cases. Brady Henderson, legal director of the American Civil Liberties Union of Oklahoma, said the court recently has focused on who is eligible for the death penalty, which is used by 35 states and the federal government.
