Former jail inmate files sex lawsuit

A former inmate at the Buchanan County, Mo. Jail is suing a former deputy for having sex with her while she was in custody and impregnating her.
Tonya Page names Christopher Birdsong as the deputy who impregnated her. She also is suing Sheriff Mickey Gill and Presiding Commissioner Tom Mann for not protecting her while she was in the custody of Buchanan County.
Mr. Birdsong is alleged to have had sex with Ms. Page on Sept. 16, 2001, and Sept. 23, 2001, according to the civil suit filed in Buchanan County Circuit Court.
The lawsuit alleges Mr. Birdsong threatened Ms. Page "to never speak of the incidents of sexual intercourse and other sexual contact or he would retaliate against her with increased punishment and make her 'time' more difficult."
The suit also alleges three counts of assault and two counts of battery against Mr. Birdsong for intentionally causing offensive bodily contact with Ms. Page.
Ms. Page was arrested in January 2001, when she was 18, for attempting to tamper with evidence in a murder case. Ms. Page concealed a knife in a shirt. The knife had been used to stab Michael Mason on Jan. 14, 2001, in the 900 block of South 15th Street.
St. Joseph teens Jamell Page and Marcus Busey were both found guilty of second-degree murder for killing Mr. Mason, of Kansas City, in an alleged drug deal.
Ms. Page and others were waiting for Mr. Page and Mr. Busey near the crime scene.
Ms. Page received a suspended sentence of one year in the county jail and supervised probation.
In June 2001 she was arrested for stealing. She pleaded guilty in August and in October was sentenced to three years in the Missouri Department of Corrections.
