Court dismisses case involving prisoner who alleged not receiving proper medical treatment

A complaint filed in federal court by a prison inmate alleging cruel and unusual punishment at the island’s Department of Corrections has been dismissed.

Inmate Francisco Arias alleged he was not receiving proper medical treatment by DOC personnel, and that the department didn’t respond to the grievance complaints he filed.

However, DOC records appeared to show Arias didn’t “exhaust his administrative remedies,” meaning he didn’t present his complaints to those higher in the chain of command at the prison. Also, Arias didn’t respond to a motion to dismiss the complaint within a deadline.

Based on this evidence, DOC’s motion to dismiss the case was granted on Tuesday, March 8, according to court documents.
