| Federal judge dismisses inmate’s $20m lawsuit against Jefferson County DA’s office |

WATERTOWN — A federal judge on Thursday dismissed a lawsuit brought by a state prison inmate who claimed he was prosecuted by the Jefferson County District Attorney’s office on a “legally impossible charge.” Justin D. Sutton, 28, now incarcerated at Great Meadow Correctional Facility, Comstock, filed suit in U.S. District Court, Syracuse, in August 2011 claiming he was unlawfully prosecuted on a second-degree attempted assault after being accused of trying to injure a corrections officer at Watertown Correctional Facility. Mr. Sutton was accused in an indictment handed up in May 2011 of trying to injure Officer Vincent Marzano by punching him in the face in December 2010 while incarcerated at the Watertown prison. Mr. Marzano testified at trial in October 2011 that Mr. Sutton lost inmate privileges for multiple behavior violations and again was found in violation of prison rules on the day of the incident.
