| Judge denies inmate release |

During proceedings Wednesday, a Curry County district court judge denied a murder defendant’s request to be released from custody and be placed on an ankle monitoring system in order to receive cancer treatment that cannot be provided by the county’s adult detention center. David Gutierrez was charged last year with first-degree murder in connection with the 2002 shooting death of Jose Valverde. On Wednesday Gutierrez’s attorney, James Klipstine, petitioned the court for his client’s release from custody based upon notification received from adult detention center personnel. “The reason we are approaching the court is the administrator of the Curry County Detention Center, Mr. (Mark) Gallegos, has indicated Mr. Gutierrez’s medical condition has deteriorated to the point that he can no longer remain in the Curry County detention facility,” Klipstine said. “As the court is aware from our last hearing, Mr. Gutierrez has a condition that is going to require surgery to treat cancer. The potential consequences of that surgery are such that the county facility can not take care of him.” Read More. |
