| Death row inmate's request for new sentencing hearing denied |

ELYRIA — Convicted killer Stanley Jalowiec has lost his latest effort to have his death sentence overturned. Lorain County Common Pleas Judge Chris Cook rejected a request from Jalowiec’s attorneys to grant him a new sentencing hearing in a decision filed Wednesday. Jalowiec’s lawyers had argued that a recent U.S. Supreme Court decision that found Florida’s death penalty process unconstitutional should also invalidate Ohio’s death penalty law. Richard Cline, chief counsel for the Ohio Public Defender’s Office Death Penalty Department, had argued in court documents filed earlier this year and during a hearing last month that the two laws had similar problems because both placed the final decision in deciding a death sentence in the hands of a judge, not a jury.
