A murder charge has been dropped against an inmate at Tehachapi prison in California accused of killing a convicted sex offender behind bars. Deputy District Attorney Michael Gutstein said he did not have enough evidence to proceed with a murder case against Shawn Louis Evans. Evans was accused of suffocating to death Richard William Maxwell, 42, in 2002. Evans is serving a 35-year sentence for 1998 burglary and robbery convictions. Maxwell was serving a 17-year term for kidnapping and sexual assault. Gutstein said he will decide soon whether to pursue charges against two other inmates in the case. The prosecutor said both men are serving life terms on murder convictions so he will need to determine if taking the case to court would be a good use of taxpayer money. |
