Three jail officers are sued by inmate

A Jefferson County (Ky.) jail inmate has filed a federal lawsuit against three Metro Corrections officers who he says beat him while he was handcuffed.
Attorneys for Adrian Garner filed the lawsuit yesterday in U.S. District Court in Louisville. It accuses officers Robert Arnold, Joshua Spenton and Scott DeJarnette of violating Garner's civil rights.
The lawsuit also names Louisville metro government as a defendant for failing to properly train and supervise the officers, as well as negligently keeping them in the department.
Garner seeks unspecified punitive damages against the officers and the city. All three officers are suspended without pay pending the outcome of criminal charges in the January incident.
The three face state misdemeanor charges of fourth-degree assault and official misconduct. They are awaiting a June trial, said Steve Schroering, the officers' criminal attorney.
Schroering said he will not represent the officers in the federal lawsuit. He has said his clients maintain their innocence.
Bill Patteson, spokesman for the Jefferson County attorney's office, said he could not comment on the lawsuit because it is pending.
Attorney Maury Kommor filed suit for Garner because his family came to Kommor and said he had been mistreated in jail.
"This man's civil rights were violated," Kommor said.
A lawsuit represents only one side of the story and does not constitute evidence.
Both the lawsuit and criminal case stem from a Jan. 16 incident in which the officers are accused of beating Garner.
The lawsuit alleges that the inmate received injuries to his face and upper body and was subjected to racial slurs. Garner is African American; the three officers accused of beating him are white.
All three have been sued by inmates who accused them of abuse. Those lawsuits were dismissed.
