Inmate sues sheriff over library |

A judge is allowing a federal inmate to sue the Porter County, Ind., sheriff over allegations the county jail has a subpar library and violates Jewish religious observance. U.S. District Court Judge Philip P. Simon dismissed claims 34-year-old David Subil of Miami made against the U.S. Marshal's Service, but is allowing his lawsuit to go forward against Sheriff Dave Reynolds. Subil is awaiting trial this fall on charges filed last year alleging he took part in a scheme to steal more than $450,000 in meats through a counterfeit check scheme. He is pleading not guilty. Subil has been held without bond at the Porter County Jail since his arrest a year ago. The Porter County Sheriff's Department has an agreement with the federal government to house federal detainees. He was recently transferred to the Metropolitan Correctional Center in Chicago. Subil sued the U.S. Marshal and Reynolds last year alleging the Porter County Jail in Valparaiso doesn't contain an adequate law library to allow him to research and prepare petitions challenging conditions of his confinement. Subil also alleges he is Jewish, but the jail denied him a Kosher diet or to possess a skull cap, called a Yarmulke, and leather boxes containing scriptural passages worn during prayer called Tefillin. |
