HUNTINGTON - A federal magistrate judge has recommended a man convicted of a 1987 Huntington murder not be granted a federal hearing, citing at least seven previous attempts the man has made for his conviction to be overthrown. Phillip Anthony Ward, 53, was convicted in 1988 of murder in the beating death of Wendy's night manager Carol Casto, 23, of Milton, after disgraced West Virginia State Police serologist Fred Zain testified to forensic evidence at the scene of the crime. Ward had won an appeal for a new trial after a hearing before Cabell Circuit Judge Alfred E. Ferguson last year, but the Supreme Court reversed the judge's decision, stating no new evidence had been presented in that appeal compared to his first, which was held after Zain was discredited.
