Boyd inmate back in custody after mistaken release |

CATLETTSBURG - The man mistakenly released from the Boyd County Detention Center on July 2 is back in custody. James D. Muth, 37, was lodged in the Boyd jail just after 10 a.m. Saturday, according to online booking records. Muth is charged with first degree assault and persistent felony offender in a pending Boyd circuit case stemming from a March 2017 incident in Ashland. Muth and another defendant are accused of having an altercation with a man that ended with the victim suffering serious injuries. Commonwealth Attorney Rhonda Copley told The Daily Independent in July that Muth was originally arrested in April 2017 by law enforcement in Ft. Lauderdale, Fla. and lodged in the Boyd jail. Former Commonwealth Attorney David Justice failed to indict Muth within the allotted 60 day time period and Muth was released from custody in June 2017. Read More. |
