Officers acquitted; inmate sentenced for outburst
By WLKY
Published: 06/20/2005

Three Metro Corrections (Ky.) officers accused of beating an inmate were acquitted last Thursday, and the man who accused the officers of the crime received a new sentence after an outburst in the courtroom.
Sgt. Robert Arnold, Officer Joshua Spenton and Officer Scott Dejarnette were on trial for their roles in an alleged altercation with inmate Adrian Garner, 32, in January. The not-guilty verdict was delivered at about 1:30 p.m. last Thursday, WLKY reported.
And in the moments after the verdict was read, Garner expressed his unhappiness by using threatening language. Judge Angela McCormick-Bisig gave Garner 30 days for contempt of court.
"I can't wait to see you on the street," Garner said to the officers as he was being led out of the court, Harding reported.
After things calmed down, McCormick-Bisig called Garner back into the courtroom. "I know you're upset, and not happy with the verdict," the judge said to Garner. "However, you 'Can't wait to see you out there' is threatening language."
Replied Garner: "It's not no threat. I just can't wait to see you on the street and be free."
During the trial, Garner and the prosecution told the jury he'd been beaten, and that there was a cover-up and conspiracy, Harding reported.
"I feel very certain it happened," prosecutor Ann Schiavone said. "I think a lot of professions stick together. That's what happened in this situation."
But jurors didn't buy it, and in the end, believed the officers and their attorneys instead, Harding reported.
"If they slammed, punched and kicked Mr. Garner, instead of Polaroids, I'd be showing you X-rays," defense attorney Alex Fleming said.
The officers, who had faced charges of assault and official misconduct, were on unpaid suspension until the end of the case. But it remains unclear what their next steps will be because it hasn't been determined if Metro Corrections will launch their own internal probe, Harding reported.
