| Inmate Sues County Prison |

A Pennsylvania inmate has sued Northampton County Prison and several officials, claiming he should be moved to a less restrictive housing unit, where he could watch TV, use a microwave oven, eat popcorn and enjoy movie night. Michael Guinta, 39, whose last address was in the 200 block of Bushkill Street, Easton, filed the handwritten civil complaint Tuesday in county court. Named as defendants are Director of Corrections Todd Buskirk, Acting Warden Scott Hoke and Ed Bartholemew, whose affiliation is listed as ''classification.'' In the complaint, Guinta said officials are violating his rights by failing to change his classification and move him to the prison's work-release area. The complaint said ''E-Block inmates,'' in addition to popcorn and movie nights, are eligible for ''prison programs/educational/employment'' as well as a lower custody level, food rewards, DVDs and a VCR and the use of ''hot water pots.'' Hoke said Guinta erred in his complaint and confused the work-release area, where inmates have more privileges, with E-Block. The two are separate units. E-Block, Hoke said, is defined as an area for ''medium'' custody. Guinta is in a maximum-custody unit. Hoke said inmates in the different units are not permitted to mingle. Guinta has a lengthy criminal history. He is in prison now, Hoke said, because he violated conditions of his state-supervised parole. Guinta on June 28, 2002, pleaded guilty to retail theft and was ordered that day to serve up to one day less than two years in the county prison. The judge ordered that Guinta's parole be handled by state, not county, officials. At the plea and sentencing hearing, Guinta said he was ''drunk and on drugs'' when he went to Boscov's at Palmer Park Mall in Palmer Township on Nov. 19, 2001 and tried to walk off with a $300 video game system. In his complaint, Guinta said prison officials are holding him in the maximum custody area because of the escape charge, which involved ''running'' from police 17 years ago. Court records were unavailable for the escape charge. The complaint said the prison handbook shows that escapes are to be held against an inmate, for classification purposes, for no more than two years after conviction. A hearing date on Guinta's complaint has not been set. |
